MANULI STRETCH U.S.A PATENT OF MULTILAYER STRETCH FILM CONFIRMED FULLY VALID BY U.S. PATENT AND TRADEMARK OFFICE.
Manuli Stretch USA Inc. (www.manulistretchusa.com), is pleased to announce that the U.S. Patent and Trademark Office (“USPTO”) has once again confirmed the validity of U.S. Patent No. 6,265,055 (“the ‘055 patent”), which claims a stretch film having seven or more layers. A Notice of Intent to Issue a Reexamination Certificate was issued on May 24, 2011, and a Reexamination Certificate will be issued in due course by the USPTO that will formally conclude the reexamination proceeding in favor of Manuli. The decision of the USPTO is final and cannot be appealed.
Manuli asserted the ‘055 patent in an infringement lawsuit against Pinnacle Films Corporation (“Pinnacle”), which was filed on December 21, 2006 in the U.S. District Court for the Eastern District of Tennessee. In the lawsuit, Manuli alleges that Pinnacle’s stretch film products infringe the ‘055 patent. This includes, without limitation, Apex Film, Peak Film and PalletLock Nanolayer film.

The successful outcome in the reexamination clears the way for Manuli Stretch to aggressively enforce its rights in the ‘055 patent.
Moreover, Manuli Stretch owns two more patents on multilayer polyethylene film for “online pre-stretched high quality films” and one more U.S. patent on Quiet Unwind Stretch Wrap Film:
• Manustif ® multilayer polyethylene film, international patent number 0781651 issued on October the 6th 1999,
• Manustif ® U.S. patent number 5916692 issued on June 29th 1999,
• Quiet Unwind Stretch Wrap Film, US patent number 6,602,598, issued on August 5th 2003.
